Conditional lien waiver generator

A conditional waiver is a promise, not a receipt. It says: when this payment reaches me, my claim through this date is released. Until the money lands, the waiver does nothing — which is exactly why it is the one to hand over when a general asks for paperwork before cutting a check.

When to hand one over

The normal exchange runs like this: you submit the pay application, the general asks for a waiver covering that application, you send the conditional version, the general releases the check, and — only if your contract requires it — you follow up with an unconditional waiver for the amount that cleared. That last step is the one worth negotiating away; a conditional waiver plus a cleared check already proves payment.

Because a conditional waiver has no effect until payment, it is safe to send early in the cycle. It is not safe to send one covering work you have not billed. Keep the through date matched to the billing period on the pay application, and keep the amount matched to the net payable after retainage.

California requires preliminary notice before a lien, a stop payment notice or a bond claim — a waiver does not replace it.
